To the fullest extend permitted by Law, we disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infrigement. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimers may not apply to you. Under no circumstances will virus transmission or other unauthorized access or use of the platform or the information contained therein. Your sole remedy for dissatisfaction with the platform is to stop using it. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions mya not apply to you.
You agree to indemnify, defend and hold harmless Phigz Limited and its affiliates, directors, officers, employees, consultants, agents and representatives from any and all third party claims, losses, liability, damages and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Platform, your violation of these Terms or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. We will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage or cost.
